Cancellation Policies:

For cancellations made prior to five days before the session date, simply send an email request to This e-mail address is being protected from spam bots, you need JavaScript enabled to view it with the session in question and your contact information.  Once we have received notice of cancellation, you will receive a confirmation email and your registration will be annulled.

In the event of cancellations made within 48 hours prior to the session date, send an email request to This e-mail address is being protected from spam bots, you need JavaScript enabled to view it with the session in question and your contact information.  Upon cancellation, you will receive a registration credit to be applied to any future session within 6 months of the session date.

***All session times are displayed in Eastern Standard Time, unless otherwise specified by BenAstrum.  Each participant is responsible for attending the session at the specified times ***

Content and Session Policies:

The Materials and Services, as well as their selection and arrangement, are protected by copyrights, trademarks, patents, trade secrets and all other intellectual property and proprietary rights (collectively "Intellectual Property Rights"), and any unauthorized use of the Materials or Services may violate such laws and the Terms of Use.  Except as expressly provided herein, BENASTRUM and its suppliers do not grant any express or implied rights to use the Materials and Services.  Participants agree not to copy, record, republish, frame, download, transmit, modify, adapt, create derivative works, rent, lease, loan, sell, assign, distribute, display, perform, license, sublicense or reverse engineer the Web Seminars, Web Curriculums or any portion thereof.  The trademarks, logos and service marks ("Marks") displayed on the Web seminars are the property of BENASTRUM or other third parties.  Participants are not permitted to use the Marks without the prior written consent of BENASTRUM or such third party that may own the Marks.  BENASTRUM and the BENASTRUM logo are trademarks of BenAstrum.

Participants shall pay all costs and charges, including phone charges and telecommunications equipment costs that are incurred in order to access or use the Web seminar, Services and Materials.  While BenAstrum provides a toll free number, there may be other communication costs associated with logging in and attending the session.  Participants must adhere to all limitations on dissemination, usage and reproduction of any Materials that are downloaded from the Web seminar that are subject to such limitations.  Participants agree to use the Services only to access Materials in an appropriate manner; participants may take notes, ask questions, view a session, type questions, as well as receive or download handouts.  As some examples of improper activities when accessing or using the Web seminar, Services or Materials, participants agree not to:

• Provide their  log in information to someone other than themselves for the purpose of attending a session
• Attend a session in conjunction with others who are not authorized to view the session, have not paid for the attendance or are not participants of BenAstrum
• Record the video portion of the session using software, web cam or any other device
• Record the audio portion of the session using software, or any other device or technique
• Collect, harvest, mine or engage in any activity to obtain e-mail addresses, phone numbers, personal information or any other information regarding participants of the same session
• Make defamatory comments when speaking to the collective audience
• Promote a company, service or themselves via the web seminar in any way shape or form
• Use or attempt to gain access to, or use another's account, password, Service, Materials, computer systems or networks connected to any BENASTRUM server or Web seminar, without authorization from BenAstrum , whether through hacking, password mining or any other means
• Remove or falsely add to any uploaded Materials any copyright, trademark or other legal or proprietary rights notices, author attributions or other information such as origin or source of the Material
• Access or attempt to access any unauthorized Materials through any means not intentionally made available through the Web seminar or Services
• Make available any files containing Materials that participants do not own or control, or have not received the necessary licenses to, as well as all Intellectual Property Rights, rights of privacy and publicity, and all other rights in and to such Materials
• Use Materials in any manner that infringes on the Intellectual Property Rights or other rights of any party
• Disrupt or interfere with the security of, or otherwise cause harm to, the Web seminar or any Services, Materials, system resources, accounts, passwords, servers or networks connected to or accessible through the Web seminar or any affiliated or linked web seminars
• Transmit unsolicited or bulk communications to a BENASTRUM account holder or any www.benastrum.com  posting, or otherwise submit any software, programs or files that are harmful or disruptive of another’s equipment, software or other property, including any corrupted files, time bombs, Trojan horses, viruses and worms
• Create a false identity for the purpose of misleading others
• Download any Materials posted by another that are known, or should be reasonably known, to be prohibited for reproduction, distribution, performance or display
• Disrupt, interfere or inhibit any other participant from attending and enjoying the Web seminar or other affiliated or linked web seminars, Materials or Services
• Access or use the Web seminar in any manner that could damage, disable, overburden or impair any BENASTRUM server/host or the network(s) connected to any BENASTRUM server/host
• Violate any applicable laws or regulations related to the access to or use of the Web seminar, or engage in any activity prohibited by the Terms of Use
• Post or otherwise submit any topic, name, material or information that is deemed to be defamatory, harassing, inappropriate, indecent, lascivious, lewd, profane, obscene, unlawful or otherwise objectionable
• Prepare, compile, use, download or otherwise copy any Web seminar participant’s directory or other user or usage information or any portion thereof, or transmit, provide or otherwise distribute such directory or information to any third party
• Violate the rights of BENASTRUM or any third party (including rights of privacy and publicity), or abuse, defame, harass, stalk or threaten other participants
• Use any BENASTRUM domain name as a pseudonymous return e-mail address
• Market any goods or services for any business purpose (including advertising and making offers to buy or sell goods or services), unless specifically permitted to do so by BenAstrum

Any violations can and will result in the termination of the participant’s rights and access, without any obligation on behalf of BenAstrum.

BENASTRUM offers no guarantees and assumes no responsibility or liability of any type with respect to the Third-Party Services, including any liability resulting from incompatibility between a Third-Party Service, BENASTRUM Materials or Services, or another Third-Party Service.  Participants agree not to hold BENASTRUM responsible or liable with respect to the Third-Party Services.  BenAstrum, in its sole discretion, may (but has no obligation to) monitor or review the Materials and Services at any time. 

BENASTRUM may at any time without notice and in its sole discretion: (a) terminate a Service, access to or use of any Materials or an area of the Web seminar where Materials are posted or submitted; and (b) disclose any information related to use of a Service or Material, or the substance of any posted or submitted Materials, as BENASTRUM deems necessary to comply with applicable law, regulation, legal process or governmental request.

All required registration information provided by Participants must be current, complete, accurate, and kept up to date on a prompt and timely basis.  When required, participants must also choose a user name and password for their account ID.  It is the sole responsibility of the participant to keep their account user name, password and other sensitive information confidential.  If a participant becomes aware of any unauthorized use of his or her account, or any other breach of security, notify BENASTRUM immediately.

Anyone performing personal or noncommercial research may view, print material, and temporarily store materials from this web seminar, provided that BenAstrum’ s copyright notices are not removed and that the reuse of material does not conflict with any of the prohibited uses below.

Except for the permitted uses above, participants agree not to reproduce, distribute, transmit (via print, fax, electronic, or other means), modify, alter, or create derivative works of the materials contained in the web seminar without prior written permission from BenAstrum.

Participants agree that materials may not be sold to third parties, without prior written authorization from BenAstrum.

Participants agree that materials may not be systematically stored on a server so as to substitute for the purchase of a subscription and/or license agreement of the materials.

BENASTRUM may block, restrict, disable, suspend or terminate participant access to all Web Seminars or a component thereof, without prior notice or liability to that participant.

By posting information during the web seminar, a participant grants BENASTRUM the right to use this material, and for others participants to access, display, view, store and reproduce this material.  BENASTRUM does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by participants, nor does it endorse any opinions expressed by participants or speakers.  Participants acknowledge that any reliance on material posted by other participants will be at their own risk.

BENASTRUM does not screen or censor participant-generated content made available during the web seminar.  BENASTRUM shall not be liable for any content posted during the web seminar or through BenAstrum forums.  Participants assume all risks associated in dealing with other participants they come in contact with through the web seminar.  Should a dispute arise between participants, the participants hereby agree to release BENASTRUM from all claims, demands, and damages associated with such a dispute.

IN NO EVENT SHALL BENASTRUM OR ANY THIRD PARTIES MENTIONED ON THE WEB SEMINAR BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE WEB SEMINAR AND MATERIALS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT BENASTRUM IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE CONTENT THAT IS POSTED ON ANY BENASTRUM WEBSEMINAR MAY CONTAIN INACCURACIES OR TYPOGRAPHICAL ERRORS.  BENASTRUM MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE WEB SEMINAR, THE MATERIAL OR OTHER POSTED CONTENT, PRESENTATION, SOFTWARE, TEXT, GRAPHICS, AND LINKS.

THE WEB SEMINAR AND MATERIALS ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND.  BENASTRUM DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT OF COPYRIGHT TO THE FULLEST EXTENT PERMITTED BY LAW.

BENASTRUM DOES NOT WARRANT THAT THE WEB SEMINAR WILL OPERATE ERROR-FREE OR THAT THE WEB SEMINAR AND ITS SERVER ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS.  IF USE OF THE WEB SEMINAR OR MATERIALS RESULTS IN THE NEED FOR SERVICING OR REPLACING OF EQUIPMENT/DATA, BENASTRUM IS NOT RESPONSIBLE FOR SUCH COSTS.

Should unexpected circumstances or an Act of God arise, BenAstrum reserves the right to reschedule a session for a later date, to accommodate the situation.

The Web Seminar, Services or Materials may include links for other websites outside of the BenAstrum domain of content (“Linked Web seminars or websites").  The Linked Web seminars or websites are provided by BENASTRUM to participants as a convenience, and the inclusion of such links does not imply any endorsement by BENASTRUM of any Linked Web seminar.  BENASTRUM has no control over the Linked Web seminars and participants therefore acknowledge and agree that BENASTRUM is not responsible for the content of any Linked Web Site, any link contained in a Linked Website, or any changes or updates to a Linked Website.  Participants further acknowledge and agree that BENASTRUM is not responsible for any form of transmission (e.g. webcasting) received from any Linked Website.

Participants agree to defend, indemnify, and hold harmless BenAstrum, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal fees, resulting from use of www.benastrum.com, any web seminar posted there in, or a breach of the Terms of Use.  BENASTRUM shall provide notice to participants promptly of any such claim, suit, or proceeding and shall assist participants, at their expense, in defending any such claim, suit or proceeding.

In the event that participants or others access or use the Web seminar, Services or Materials in connection with the transmission of spam newsgroup postings or unsolicited e-mail in violation of these Terms of Use, participants acknowledge and agree that BENASTRUM will be irreparably harmed there under and that monetary damages will be an insufficient and ineffective remedy; therefore, participants agree that BENASTRUM is entitled to obtain immediate injunctive relief against any such transmission (in addition to all other remedies available at law or in equity).  BENASTRUM may without restriction block, filter or delete unsolicited e-mails.

BENASTRUM may run advertisements and promotions from third parties via the Web seminar, Services or Materials in any manner or mode and to any extent.  Communications, activities, relationships and business dealings with participants and any third parties advertising or promoting via the Web seminar, Services or Materials, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, shall be solely matters between the participants and such third parties.  Participants acknowledge and agree that BENASTRUM is not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings, or as a result of the presence of such non-BENASTRUM advertisers on the Web seminar or in connection with the Services or Materials.

It is the express wish of the parties that the Terms of Use and all related documents have been drawn up in English.  C'est la volonté expresse des parties que la présente convention ainsi que les documents qui s'y rattachent soient rédigés en anglais.

If participants access a web seminar from outside North America, they do so at their own risk.  These Terms of Use are governed by laws of the province of Quebec.  Jurisdiction for any claims arising under these Terms of Use shall lie exclusively with the provincial or federal courts within the province.  If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect.  No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term.

It is prohibited to transfer the Terms of Use, or any right granted hereunder, without BenAstrum’s prior written consent.  If for any reason a court of competent jurisdiction finds any provision of the Terms of Use, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties as reflected by that provision, and the remainder of the Terms of Use shall continue in full force and effect.  Any failure by BENASTRUM to enforce or exercise any provision of the Terms of Use or related right shall not constitute a waiver of that right or provision.
